By accessing, registering for, or using Hasta Haus ("the Platform", "we", "us", "our"), you ("User", "you") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not use the Platform.
These Terms constitute a binding legal agreement between you and Hasta Haus, operated under the laws of British Columbia, Canada. Use of the Platform by any person under the age of 18 is strictly prohibited.
To participate in auctions or list beats you must register for an account. By registering you represent and warrant that you:
Hasta Haus reserves the right to refuse registration, suspend, or permanently terminate any account at its sole discretion, with or without notice, for any violation of these Terms.
Terminated users may submit a written appeal to legal@hastahaus.com within 14 days of termination. Appeals are reviewed at our sole discretion and our decision is final.
Producer accounts require a recurring subscription of $12.00 CAD per month, billed through Stripe. By subscribing you authorize Hasta Haus to charge your payment method on a monthly basis until cancellation.
Producers agree to:
Subscriptions may be cancelled at any time. Access continues until the end of the current billing period. No partial refunds are issued for unused subscription time.
If a Producer's subscription lapses while an auction is active, the auction will continue to completion and the Winning Bid will be charged to the Buyer as normal. The Buyer retains their license and receives the Beat file regardless of the Producer's subscription status. Hasta Haus will notify the Producer by email of any subscription payment failure and of any funds held on their behalf.
If a Producer's subscription payment fails and the Producer holds funds from completed sales, Hasta Haus may apply those held funds toward the outstanding subscription fee ($12.00 CAD) for that one billing cycle. This set-off is applied once only. If the Producer's payment method remains invalid in any following cycle, Hasta Haus will not draw again from the Producer's held funds; instead, the account's paid-account features remain suspended until the Producer brings billing current themselves. Any funds remaining after the single set-off remain the Producer's property, held by Hasta Haus until withdrawn. Hasta Haus does not forfeit or take ownership of a Producer's sale proceeds.
After 9 months of account inactivity, Hasta Haus may suspend or close the account. Any funds held on behalf of an inactive Producer will be handled in accordance with applicable unclaimed-property law; Hasta Haus does not claim ownership of unclaimed funds except as permitted by law.
Active auctions continue to their natural end date regardless of the Producer's subscription status. Auctions that expire during or following a lapsed subscription period are visible in the Producer's dashboard as Ended listings and are removed from the public auction feed. Producers may relist any Ended beat once their subscription is reinstated, with the option to update the beat's title, metadata, starting bid, and auction duration at the time of relisting. The original Beat file is retained for relisting purposes until the Producer chooses to permanently delete the listing. Permanent deletion removes all associated Beat data, metadata, and files from the Platform's systems within 30 days. Hasta Haus is not liable for any loss of data following a Producer-initiated deletion. New auction listings are suspended for the duration of any lapsed subscription period.
Comped accounts are granted at the sole discretion of Hasta Haus and carry identical responsibilities to paid accounts. Comped status may be revoked at any time without notice. Revocation of a comped account does not entitle the holder to compensation of any kind.
Producers set the auction duration at the time of listing. Public auctions run 24, 48, or 72 hours; private auctions run 3, 7, or 10 days. The auction duration is fixed at the time of listing and cannot be altered once the auction is live. The following rules govern all auctions:
Auctions with zero bids at close expire without obligation to either party. The Producer may relist the Beat at any time at no additional cost beyond their active subscription.
All payments are processed exclusively through Stripe. Hasta Haus does not collect, store, or have access to any payment card information. All card data is handled by Stripe in accordance with PCI DSS Level 1 standards. To place a bid you must keep a valid payment card on file. No deposit or hold of any kind is placed on your card for bidding. By placing a bid you authorize:
At auction close the highest valid bid wins and the Winning Bidder's card is charged automatically for their bid amount plus the 5% Platform Fee. If that charge declines or fails, the auction cascades to the next-highest bidder, whose card is charged their own bid amount plus the 5% Platform Fee, and so on in descending order until a charge clears. If no bidder's payment clears, the auction is unsold and the Producer may relist the Beat.
Producers receive 100% of the Winning Bid amount. Hasta Haus earns revenue solely through the 5% Platform Fee charged to the Buyer and through Producer subscription fees.
Producer payouts are processed through Stripe Connect. Producers must complete Stripe's identity verification (KYC) process before receiving any payouts. Payout timing is subject to Stripe's standard processing schedule and any applicable holding periods. Hasta Haus bears no liability for payout delays caused by Stripe's processing timelines, identity verification requirements, or third party banking systems.
If a Producer's Stripe Connect account is invalid, suspended, or unable to receive funds, Hasta Haus will attempt to notify the Producer and hold funds for a period of 30 days. If the issue is not resolved within 30 days, Hasta Haus reserves the right to return funds to the Buyer and void the transaction.
All auction prices, winning bid amounts, and Producer subscription fees are denominated in CAD. Currency conversion fees and exchange rate variations are the sole responsibility of the user and are governed by Stripe's currency conversion policies. Hasta Haus makes no representations regarding exchange rates.
Producers are solely responsible for reporting and remitting all applicable income taxes, GST/HST, and any other taxes or levies on earnings received through the Platform. Hasta Haus may issue tax information forms to Producers as required by Canadian law, including T4A slips for earnings exceeding applicable thresholds. Nothing in these Terms constitutes tax advice.
Buyers located outside Canada may be subject to import duties, withholding taxes, or other charges under the laws of their jurisdiction. These are the sole responsibility of the Buyer.
By completing payment for a won auction and receiving the Beat file, the Buyer acknowledges that the transaction is final and agrees to waive any right to initiate a chargeback or payment dispute with their card issuer or bank, except in cases of verifiable fraud or non-delivery.
If a Buyer initiates an unauthorized chargeback after receiving a Beat file, Hasta Haus reserves the right to:
Hasta Haus will cooperate with Stripe and financial institutions to contest fraudulent chargebacks and provide evidence of delivery where applicable.
Upon receipt of full payment from the Winning Bidder, the purchased Beat file is delivered automatically and immediately to the Buyer's account. The full file — in the format the Producer set at listing (MP3 or WAV) — is released to the Buyer's account, where it remains available for download. A license certificate is issued automatically, and the auction's Verification ID transfers to the Buyer as a permanent, publicly verifiable record of the sale at hastahaus.com/verify.
Hasta Haus retains a copy of all Beat files uploaded to the Platform for the duration of the listing and for a period of 90 days following auction close. Files are permanently deleted after this period unless required for legal or dispute resolution purposes. Hasta Haus does not use, distribute, or sublicense Beat files for any purpose other than facilitating the auction and delivery process.
If a technical failure prevents automated delivery, Hasta Haus will use commercially reasonable efforts to make the Beat file available promptly. If delivery cannot be completed, the Buyer is entitled to a full refund of the Winning Bid amount and Platform Fee, processed within 14 business days of a verified non-delivery complaint.

Hasta Haus reserves the right to remove any listing that violates this section without notice, without refund of subscription fees, and without liability to the Producer.
Hasta Haus respects intellectual property rights. If you believe a Beat listed on the Platform infringes your copyright, submit a written notice to legal@hastahaus.com containing:
We will investigate all valid notices and may remove listings or suspend accounts pending resolution. Filing a false infringement claim may result in account termination and legal liability.
Users may not engage in any of the following:
Violations may result in immediate account termination and referral to appropriate law enforcement authorities.
In the event of a dispute between a Producer and Buyer, both parties agree to first attempt resolution in good faith by contacting Hasta Haus at legal@hastahaus.com within 30 days of the event giving rise to the dispute. Hasta Haus will review the dispute and may, at its sole discretion, mediate between the parties. Hasta Haus's decision in any mediated dispute is final and binding on both parties as a condition of platform use.
Disputes that cannot be resolved through the above process shall be submitted to binding arbitration in Vancouver, British Columbia under the rules of the BC International Commercial Arbitration Centre. Each party bears their own legal costs unless the arbitrator determines otherwise.
Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm.
All sales are final. Hasta Haus does not issue refunds on completed auction payments or Platform Fees except in the following circumstances:
Subscription fees are non-refundable. No partial refunds are issued for unused subscription time.
Eligible refund requests must be submitted to legal@hastahaus.com within 14 days of the event giving rise to the claim. Hasta Haus will process approved refunds within 14 business days.
Hasta Haus collects and processes personal information in accordance with our Privacy Policy and the Personal Information Protection and Electronic Documents Act (PIPEDA). By using the Platform you consent to the collection and use of your information as described in our Privacy Policy.
Transaction records, bid history, and payout records are retained for a minimum of 7 years following the transaction date for legal, tax, and regulatory compliance purposes, even after account deletion.
Hasta Haus complies with the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) and all applicable FINTRAC regulations. We reserve the right to:
Users in jurisdictions subject to sanctions or export controls represent and warrant that their use of the Platform does not violate applicable laws.
Hasta Haus reserves the right to delay or withhold payouts on any transaction pending completion of enhanced due diligence. Users will be notified of any hold and the estimated resolution timeframe where permitted by law.
Hasta Haus complies with Canada's Anti-Spam Legislation (CASL). By creating an account you provide express consent to receive transactional emails related to your account activity including auction updates, payment confirmations, and payout notifications.
Marketing communications are sent only with your separate express consent. You may withdraw consent to marketing communications at any time by clicking the unsubscribe link in any marketing email or by contacting legal@hastahaus.com.
Withdrawal of marketing consent does not affect your receipt of transactional emails necessary for the operation of your account.
The Platform relies on third party services including Stripe for payment processing and Supabase for data storage and authentication. By using the Platform you acknowledge that:
Hasta Haus shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, third party service failures, cyberattacks, or pandemic-related disruptions. In such events Hasta Haus will use commercially reasonable efforts to restore service as soon as practicable.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Hasta Haus does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, Hasta Haus, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
Our total aggregate liability to any user for any claim arising from use of the Platform shall not exceed the greater of $100 USD or the total fees paid by that user to Hasta Haus in the 3 months preceding the claim.
You agree to indemnify, defend, and hold harmless Hasta Haus and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, your infringement of any third party rights, or any content you submit to the Platform.
These Terms are governed exclusively by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of British Columbia for any matter not subject to arbitration under Section 13.
Hasta Haus reserves the right to amend these Terms at any time. Material changes will be communicated to registered users by email at least 14 days before taking effect. Your continued use of the Platform after the effective date of any amendment constitutes acceptance of the revised Terms. If you do not agree to the amended Terms you must discontinue use of the Platform.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and Beat Licensing Terms, constitute the entire agreement between you and Hasta Haus with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.
